SM&CR DOCUMENT PACK
From 9th December 2019, the FCA are extending their Senior Managers & Certification Regime (SM&CR) to apply to all FCA solo-regulated firms (including insurers and CMC’s) authorised under Financial Services and Markets Act 2000. The SM&CR will replace the current APER requirements and incorporate the fitness and propriety rules. Rolled out to the banking sector in 2016, the FCA’s aim in extending the SM&CR is to ‘reduce harm to consumers and strengthen market integrity by creating a system that enables firms and regulators to hold people to account’.
The FCA have already published a detailed SMCR Guidance Document to help firms assess which firm type they are; what Senior Management Functions (SMFs) and Prescribed Responsibilities (PRs) apply; how to assess fitness and propriety and complying with the Conduct Rules. They have also provided a SMCR Checklist to bring together the information and help firms with what they need to do to implement the regime.
